Dear Madam,

As independent journalists, my wife and I were involved in the people’s struggle protest “Aragalaya” during the past 100 days and have captured and reported its incidents and highlights. We also have voluntarily archived the footage for future use.

During these critical incidents, we were directly exposed to the tear gas fired at the protestors by the military many times. After the 50th day of the Aragalaya demonstration, I fell ill due to being directly exposed to the tear gas that hit the barricade of the journalists. The illness persisted for over a month with respiratory tract infections such as high fever, tight chest and wheezing.

Once again, we were directly exposed to the extensive tear gas firing on the 13th of July when we were reporting from the Prime Minister’s Office. The tear gas firing continued for hours. Since that day, my wife and I have fallen seriously ill with severe symptoms including continuous headaches, eye irritation, sore throat, tight chest, breathing difficulties etc. Public accusations continue that the tear gas fired on that day is expired. Today we underwent a medical examination, including an X-ray of the head and lungs. Ths chest physician informed us we had reached a level of asthma and lung infection due to extensive exposure to tear gas.

We are willing to come forward if any legal action can be taken in this regard. If necessary, we can produce video and photo evidence. As we know, we are not the only ones who are affected by this incident. According to our understanding, Many other young people and journalists are currently sick. We strongly believe that the use of expired chemical substances by security forces who should be protecting the state and its citizens is a severe violation of fundemetal rights stated in chapter III, sections 10, 11, 12, 14 (a) – (g) according to the Constitution of the Democratic Socialist Republic of Sri Lanka.

Theefore, I would like to raise a formal complaint to the Human Rights Commission in Sri Lanka to investigate this case and serve justice.

Thank you
Sincerely,
Kasun Pussewela
